Examining a chosen area of media law that relates to the processes or Essay
Examining a chosen area of media law that relates to the processes or business practices involved in magazine publishing - Essay Example This paper aims at discussing the levels to which the law gives such individuals right to privacy. This will be in relation to the right and freedom given to the magazine publishers by the constitution. The intellectual property right is the right given to an individual to control any of his or her intellectual creations. Mostly violation of this right by magazine publishers through publication of these creations without the ownerââ¬â¢s permission this may involve the inclusion of photographs a written work by individuals the on the public eye. If a magazine publisher chooses to use any person material without their consent, this would be termed as a violation of intellectual property rights (Phillips & Firth 1999:84). Some of the victims of such violation are photographers, visual artists, and literal creations. If magazine publishers would use images of works by famous photographers without their assent, they would be guilty of violation of this right. However, the magazine can always use these creations by getting in touch with the persons involves and getting either written or verbal assent for the use of these creations. Another form of intellectual property right mostly abused by magazine publishers is the trade secrets. The trade secrets include confidential information that a business or a person uses to get an advantage over their competitors. This information might negatively involve the parties involved if the information gets to the public. A perfect replica of such an incident is one where maybe an artist had a formula or a manner in which he came up with his work. If a magazine publisher publishes this information without the consent of the artist, then the artistsââ¬â¢ privacy would have been invaded. The magazine publisher, however, has the right to print this information if the secret of trade violated human rights in any way. The law protects individuals from exploitation just to some limit. Contract law is a section of law that is funda mental for the making of oral and written agreements. These kinds of agreements usually have an association with exchange of goods and services, money, and properties. It entails topics such as the nature of responsibilities, limitation of actions, freedom of contract, privacy of contract, termination of contract and covers also agency relationships, commercial paper, and contracts of employment. In this case, the contract would involve the publisher and the public figure. Such agreement always involves information on the nature of co-existence between the two parties. Magazine publishers sometimes use information about some of the public figures to come up with some of their article. There are cases where the magazine publishers have an agreement of exclusion of some of the information. In such an incidence, it would be a breach of contract if the magazine publishers goes ahead and publishes the information The law of libel protects each and every person from defamation in whatever means. Libels refer to written defamation. This may take place if a magazine publisher decides to publish a story that defames. If it would be proved that the information on the publication is not true, then the publisher will be guilty of defamation. Defamation always takes place as a result of gossip or speculations. When this takes place, the victim usually experiences hatred, shame, disgrace, contempt or ridicule. In some cases, the victim can even experience all the mentioned outcomes. Victims of defamation; however

Clean Edge Case Study Example | Topics and Well Written Essays - 500 words
Clean Edge - Case Study Example The company is also experiencing growth in sales of other products implying that customers have confidence in the companyââ¬â¢s products. The weaknesses off the company include inability to reach a consensus in relation to branding and marketing. Managers are specifically interested in the success of their brand rather than for the good of the company. Threats include substitutes and new entrants. The major competitors in the industry are also producing non-disposable razor products and thus the company must brace itself for stiff competition. Also, entrant of new firms will increase the amount of substitutes in the market. The behavior of the customers in regard to this product is clear. The consumers are gradually changing from replacement razors to the non-disposable razor products. The customers are expecting newer and advanced technologies that will give them a smoother shave. In this regard, consumers are increasingly choosing the super-premium category. Launching Clean Edge as a Niche product means that the product will focus on a few highly groomed persons who want a different shaving capability. It is the most preferred strategy among the company managers. Launching Clean Edge as a mainstream brand means that the product offers the regular shaving experience. The managers think that the strategy would cannibalize the market of other company products such as Pro. To avoid cannibalization of other company products, I recommend Clean Edge to be launched as a niche product. Launching it as a niche product will also enhance the productââ¬â¢s position as a super-premium product. I would recommend the name Paramount Clean Edge. The name would enhance the companyââ¬â¢s name and enhance in brand positioning. Launching the product under the name Paramount would reap from the reputation of the companyââ¬â¢s products. The name will also boost the visibility of the

Changes in the Marketing Environment Essay Example for Free
Changes in the Marketing Environment Essay In recent times, from an economic environment perspective, people are getting more affluent, even in third world countries like Vietnam, the younger generation are more interested in spending on the latest fashion and gadgets, like iPods. Phone marketers might want to include phone designs which allow for self-expression, hence catering to the younger people seeking to carve out their own identity. For example, young girls in Japan like to stick many shiny crystals on their phones as they see it as a form of beautiful art. Phone marketers can cash in on this growing trend by offering phones which have suitable surfaces for crystal gluing, and they might want to also consider having a tie-up with a suitable bead company in order to have a package selling the crystals together with the phones. An important marketing strategy in catering to the changing political environment would be cause-marketing. It is by cause-marketing that phone marketers can reassure the public that they are socially responsible, even in the midst of increasing unethical behaviour existing in society. Cause marketing might be the determining factor which might set a phone or a brand of phones apart, especially if customers have the same perception of 2 brands of phones and are undecided which to choose. Phone marketers can follow Motorolaââ¬â¢s lead whereby they produced a red ââ¬Å"razrâ⬠phone to promote awareness of aids, which was highly successful. Another important marketing strategy is for the marketer to observe the changing demographic forces and decide which target group they can focus on in order to make the most profits. Quite a few countries in the world are facing an aging population, like Japan, China and Singapore. This might be a good target market to go into, by manufacturing phones which are suited for older people like by having larger screens and more user-friendly buttons. Technological forces are constantly changing, and a good marketer would be able to foresee what kinds of functions people might want in their phones. Marketers might want to research about what form of entertainment is capturing people and cater to these needs. Sony Ericsson realised that music was slowly becoming an integral part of peopleââ¬â¢s lives, no matter what age and produced the walkman phone series which was highly popular. The path to success and its maintenance depends very much on a phone marketerââ¬â¢s resellers and suppliers, hence phone marketers should engage in tie-ups with them both. A phone marketerââ¬â¢s resellers normally consist of telecommunications companies.à Marketers can offer to sell their phones at a lower price to these companies, and in exchange, persuade them to offer more attractive or cheaper line subscription packages when customers purchase the phones of the marketersââ¬â¢. Marketers should constantly source for more efficient and cheaper suppliers and sign a long-term contract with them. Marketers might also want to consider suppliers based in China or India, as labour in such countries is known to be one of the cheapest, yet efficient, in the world. Lastly, marketers should always keep an eye out for competition and continually check on other phone marketersââ¬â¢ strategies and phone pricing. Marketers should also be aware that competition not only lies with other phone marketers, but in any company that has to do with providing entertainment or convenience to people. For example, Apple is not a phone manufacturer, but it is beginning to slowly capture the phone market due to its iPhone. Phone marketers might want to produce phones which have the capability to rival such phones, or if they are unable to do so run a major advertisement campaign to promote their phones against other rival phones, so as to hopefully mould the publicââ¬â¢s thinking into their liking. Alternatively, phone marketers can also liaise with major entertainment companies like Apple or Creative to work together to produce quality phones or gadgets to capture a major share of the phone market.
Research On The Importance Of Financial Planning Finance Essay
Research On The Importance Of Financial Planning Finance Essay The financial plan is an important part of both the business plan and of the entrepreneurs day-to-day management of operations. The financial planning puts the entrepreneur in touch with the realities of a financing request. This understanding will help clearly identify the amount of financing needed, the purpose for the funds, the length of time the funds are needed, and how the financing will be repaid. These issues are of key concern to the prospective financier Financial Plan The various operating plans prepared by the entrepreneur indicate where the firm is expected to go and how it will get there. The financial plan estimates and plans for the financial needed to implement these intentions. It, along with the market analysis and marketing plan, is the most critical component of the business plan. (Arthur and Stephanie, 1995) Some entrepreneurs might think of the financial plan as being strictly about the numbers, it is much more than that by providing a basis for making many decisions about the business. Decision such as how many employees to hire, what suppliers will be used, and what equipment will be purchased will be largely made while completing the financial plan. As is true with marketing and operations, one plan has to be streamlined with the other. The financial plan needs to reflect the marketing activities and the level of production that were outlined previously in the plan. (Arthur and Stephanie, 1995) Good financial planning helps a company maximize cash flow with pinpointed resource allocation and investment strategies. On the other hand, that means money can become tied up in long-term investments and investment strategies And if a companys strategic plan or financial plan ends up being woefully wrong, it may not have the money it needs to immediately rectify a problem. (Brian Boone, 2004) Its much harder to convince shareholders and stakeholders of a company how to properly execute the companys finances; its easier to get everyone behind a strategy, because its goal-oriented, not cash-oriented. But the two can be integrated. (Arthur and Stephanie, 1995) Financial plan calculation statements (shown in Appendixes) Business Plan A business plan is a document that is used to guide the new entity created by an acquisition or joint venture project. Business plans vary by project and are shaped by many considerations, but the basis of business plan is the development of the mission, goals, and objectives of the new entity consistent with the strategy, goals, and objectives of the acquiring or the parent company. The business plan includes a fairly detailed financial plan describing the timing and quantities of key financial variables with respect to revenues, expenses, capital outlays, and cash flows. However, providing performance targets and monitoring operational performance, linking management objectives and performance with operational performance, and describing a feedback and control mechanism to assess the new entity performance versus expectations and targets are value-added characteristics. The business plan is an important communication tool for delivering a consistent message concerning acquiring or parent firm expectations, goals and objectives, priorities, and operational targets of the new entity. Another useful function the business plan performs is to lay out requirements and issues that need to be addressed, coordinated, or resolved. Finally, as the environment and operating conditions change, the business plan provides the structure to evaluate the impact of changes on strengths and weaknesses of new entity. (John, 1999) A good business plan for a sound business concept can helps to achieve in business goals. It can saves the companys money and time by focusing on the business activities, and giving more control over the finances, marketing, and daily operating and helps to raise the capital of the company. (Rhonda, 2003) Bank loan Borrowed money is often the key to building and growing a successful small business. For independent business owners, however, courting lenders isnt always easy. Heres how to make a strong case and win over even the choosiest banks. By Matt Alderton. Small business owners can choose bank loan when they need to borrow money. But, if the owner having a bad credit record can be a big hindrance in terms of asking financial assistance in the future and this is a fact everyone should remember in making future loans. Messing up with the financial liabilities can land in with a bad credit record. It would be difficult to borrow money with bad record. Financial institutions like banks and even small lending organizations are strict with customers wanting to borrow money with bad record since it might be a bad investment for them. People in dire need of financial assistance with a bad credit record can just put them in the brink of bankruptcy. 5.0 Question 3.1 The companys projected sales are exceed the company objectives and the company accountant decides to advise the Board of Director later, therefore the companys financial plan may be ineffective because of the delaying release the information to the Board of Director. As there the demand is higher as the companys objective, the delaying to inform the Board of Director about the exceed sales, the director will unable to borrow loan from the bank because of the qualification may be failed. Mostly, bank wouldnt borrow loan to high-risk borrower due to the poor credit profile of the borrower, the bank would worried that the borrower might not affordable to payback for the loan if the company is almost facing a huge run out of funds. The financial plan will be ineffective and confused all the operating system of the production. The I.R.A: Activists or Terrorists? :: essays research papers fc
I do not support the I.R.A, as I do not support Marxist or terrorists. The political wing of the I.R.A (Sinn Fein) is communists hiding under a nationalist stance. Gerry Adams is the man who heads the Sinn Fein; the man who replaced Martin McGuinness as the leader of the Sinn Fein. The actual I.R.A has splintered due to the communist tyranny the Sinn Fein has invoked on them. Thereââ¬â¢s the real I.R.A who are nationalists and wanted the British out. The will not talk to the British, as they feel they are foreign invaders. Then there's the Provo I.R.A and there nothing more then Marxist terrorist. There whole strategy is based on very fashionable Marxist politics. The current Provo I.R.A slogan ââ¬Å"I ran awayâ⬠plainly states,â⬠It doesnââ¬â¢t matter if we are Marxist, just blindly follow usââ¬Å". Now the I.R.A had a legit fight, but once there political wing got corrupted with the red disease, everything went down hill. They started going after protestant church es, little children and other innocent people. That's not tolerable, itââ¬â¢s one thing to go after military targets and other government institutes, but once you start going after innocent civilians, that's crossing the line between activist and terrorist thug. The U.D.A (Ulster Defense Association) is no better, as there more concerned with there drug trafficking, then defending Ulster from these Marxist Terrorist. Now I want a united Ireland, it sickens to me to hear bout these so called nationalists killing there own brothers over some church divisions. A united Ireland is what I want to see, I want to see them unite and rid Ireland of there true enemy, the Marxist who have for the last 40 years been playing with there lives. In the 1920ââ¬â¢s, the British wanted to get out of northern Ireland as it was during World war 1. Britain did not have one solid voice. So they pulled out. There was a protestant majority that felt they where British, and wanted to stay British. So Britain decided to partition Ireland. The Brits would take control of the northern part of Ireland, and call it Northern Ireland. They would leave the rest of the island for the Irish. Neither side was happy about this outcome. The majority of the Irish bitterly accepted this. They felt Northern Ireland would collapse under itââ¬Ës own weight. A group of brave Irish nationalist did not stand for this, and fought tooth and nail to rise against the British.
Personal Narrative on Friends :: essays research papers
When youââ¬â¢re young, you donââ¬â¢t care about how a person looks or acts, theyââ¬â¢re just people, friends. Growing up, youââ¬â¢ll find that qualities a friend has to have or canââ¬â¢t have become very important. It took a special kind of friend to show me that the true heart of a person is what really counts. Almost at the age of seven, I made a friend named Dani. I liked being with her because she was always smiling. We played together and giggled a lot. Sometimes, sheââ¬â¢d randomly dance, spin around, or run away alone, but I never cared or wondered why. One day, there were these older kids pointing and laughing at her. I skipped up to them. ââ¬Å"Daniââ¬â¢s my friend,â⬠I blurted out happily. They laughed even harder. ââ¬Å"Donââ¬â¢t hang with her, kid. Sheââ¬â¢s mental,â⬠the one whose face was the most red warned me. ââ¬Å"Huh?â⬠I was puzzled. ââ¬Å"Yeah. Sheââ¬â¢s like- a retard!â⬠again, they looked like hyenas, laughing their heads off as they walked away leaving me totally confused. I didnââ¬â¢t think there was anything wrong with Dani, but there was a large part of me that just had to listen to the big kids because they were always right. The next day at school, I tried to avoid Dani. The cool kids said she was a ââ¬Å"retardâ⬠and that didnââ¬â¢t sound good. At recess, I sat on the ground, lonely. Suddenly, I heard the loud familiar laughs from yesterday. I looked to my left and saw the same cool kids. I also noticed Dani, dancing with something she picked off of the ground. ââ¬Å"Jessica!â⬠her eyes lit up. The other kids stared at me, as if I was some translator for two very different languages. Dani stood up and was about to hug me, but I moved away. ââ¬Å"No, Dani!â⬠I couldnââ¬â¢t believe myself, I was talking to her as if she were a dog. ââ¬Å"You are a ââ¬Ëre-tardââ¬â¢,â⬠I still didnââ¬â¢t really knew what that meant, but using the word made me feel older. ââ¬Å"Iââ¬â¢m not playing with you anymore.â⬠I tried to look like my mother when she refused to buy me more candy. Dani studied my face for a moment. ââ¬Å"Go away!â⬠I exclaimed. That did it. Dani cried, and I felt cold tears sliding down my cheeks too. She scurried away until I couldnââ¬â¢t see her anymore. The big kids were practically choking on their saliva, laughing so hard.

Mid-Term Break – Creative Writing
I was in the college sick bay all morning panicking and wondering why I was sat in this small clinical room. I was left alone lying on the old squashy but cold bed. I was listening to the bells ring every hour. I was wondering what lesson I should be in now if I had not been in this uncomfortable, small cramped room. At last, the school nurse walked in and said to me ââ¬Å"Simon your next door neighbours are hereâ⬠. I picked up my coat, put my bag on my back, and walked to the school reception where my neighbours were stood. My neighbours were nice people. They were the type that would help out, like picking me up from school or baby-sitting my brother. My neighbours came and gave me a hug and sat me down by the school reception and said ââ¬Å"Simon, we have some bad newsâ⬠. All sorts of things were running through my head at that moment, I thought that their cat had died or something but these words came out ââ¬Å"Your brother is in hospital. He has been run over by a carâ⬠. On the way home I felt sick. Tears were trickling down my face while I was thinking if my brother was okay or not. On the way home the journey felt like five hours rather that ten minutes. When I finally got home, I saw my father crying in the porch. I tried to comfort him but I was too worried myself to be of any real help. I thought I knew what had happened, my father does not really cry when somebody dies but this time he was really crying. He was alone in his own world. He was cold and noises were muffled. The tears clouded his eyesight. As I entered the house, there were many people talking about different things. I could not tell what they were saying; it was just one loud noise. I could make out big Jim Evans, my uncle, who was saying in a solemn voice, ââ¬Å"it was a hard blowâ⬠. My younger sister, Natalie, was in the pram rocking and laughing as though nothing had happened. I wished that I could do that; just pretend that nothing had happened. I went upstairs to my bed room and was met by lots of old men whom I had never seen before, I was embarrassed when they all stood up and started to shake my hand, they told me they were sorry for my trouble. I locked on to someone saying that I was the eldest child away at boarding school when my brother had been run over. I was holding my mums hand when I heard this. At ten o'clock on Tuesday morning, my brother's corpse arrived at the house and was taken upstairs to the attic. The corpse was bound in bandages and they were stained in blood around the body. This made me feel sick. I wanted to get out of the room as quick as I could. The following morning I went upstairs into the attic to say my goodbyes. The room was cold and many candles were lit around the corpse to show respect. Snowdrops soothed the atmosphere and made everything calm. I saw him lying in the coffin. It was the first time I had seen him in six weeks because I had been away at boarding school. He was lying there, but more stiff and paler than I had seen him six weeks ago. He was lying there with a poppy bruise on his left temple where the car had hit him. It appeared as though he was fast asleep in his bed, but it was not his bed, it was a coffin. He had no gaudy scars because the bumper had knocked him clear. This made me feel sick again but I did not want to leave the room. His box was four foot long as if this was a foot for every year.
